My wife and I have settled 2 credit cards thru a debt settlement company with no problems. We are now in the process of settling hers, this is the last one. But, now it was sent to a law firm and now she has to go to court. We have a little saved up in our acct. w/ the settlement company. Was wanting to know if this has happened to anyone and if so, when you went to court were still able to pay off your debt when a settlement was reached or what.
Debt settlement?
This happened to a friend of mine recently.
When she went to court, they set a wage assignment.
Her paycheck is being garnished each month to cover what she owes.
State law will dictate how much it will be.
The company was willing to take a settlement for way less than the amount however, my friend did not have anything near the amount.
They also tacked on court costs and attorney%26#039;s fees.
Suprisingly it was not as bad or as scary as she thought it would be. Everyone was very nice
Debt settlement?
When you say %26quot;settlement company%26quot; I really don%26#039;t know what you mean, so bear with me.
I have a family member going through this. So now you%26#039;re at the point where the debtor wants to start garnishing your wages, right? Once she went to court, it was too late -- the opposing lawyers weren%26#039;t willing to settle, but that doesn%26#039;t mean YOUR debtor won%26#039;t be willing to settle.
If you have money saved, you can always send money to the debtor, and once it%26#039;s paid off (with your combined savings and maybe after a couple garnishments), you go back to court to show the judge how much you paid, the debt%26#039;s paid in full and you want the garnishments to stop.
When you go to court the first time, the judge just might order the lawyer to accept your payment right then and there and cancel the debt -- you just never know. You can also ask the judge the postpone a garnishment if you need him to, but it sounds like you have some money to pay. But truthfully, if you%26#039;re going to court, they want to start wage garnishments on your wife and once that happens, you%26#039;re at their mercy until the thing is paid off.
Debt settlement?
The debt settlement company should still be able to help you. Remember that, just because they sent your account to a lawyer%26#039;s office, does not mean that they already have a judgment against you. You will still have full opportunity to explain your position to the judge and should still be able to settle with them.
Again, you need to get back to your settlement company and tell them that things need to be sped up. This kind of thing does happen, even though you had signed up for a settlement program. No need to panic, just go with the process, you should be able to get a settlement out from them.
